In the last years, climate litigation became a main topic for courts worldwide. Claims are filed with national and international courts against governments, requesting them to intensify their climate protection measures. The Sabin Center for Climate Change law counts 179 cases against governments for greenhouse gas emission reductions, including cases before the European Court of Human Rights and the ECJ.
Besides claims against governments, more and more cases against corporations are filed. After the famous Shell judgement of the District Court in The Hague (which is now up for review in the Court of Appeal), NGOs in countries such as Germany have copied this and started filing claims e.g. against carmakers. Existing and upcoming rules such as the French loi de vigilance or the German Lieferkettengesetz offer further opportunities for claims.
Our webinar discusses recent developments in the Netherlands, France, Germany and Italy. Speakers will try to assess how this field of law further develops and what should be expected in the near future.
